Terms of Clearance: The justification for requiring all vessels engaged in water borne commerce to report all arrivals and departures is not adequately justified. There are many other sources of general information--VTS, Customs, Port authorities, Marine terminal, and pilots. There is good cause to require this reporting by vessels carrying hazadous materials, not others. CG should rethink the program and sould resubmit a new package after evaluating cmments on the forthcoming NPRM.

Abstract: THE PORTS AND WATERWAYS SAFETY ACT AUTHORIZES THE COAST GUARD TO REQUIRE PREARRIVAL MESSAGES FROM ANY VESSEL ENTERING A PORT OR PLACE IN THE UNITED STATES. OWNERS OR OPERATORS OF THESE VESSELS MAY APPLY TO THE COAST GUARD FOR A WAIVER OF THESE REQUIREMENTS.
