Terms of Clearance: HUD IS CLEARED TO COLLECT THE EXISTING INFORMATION COLLECTION REQUIREMENTS CONTAINED IN THEIR CURRENT RULES THROUGH OCTOBER 1986. ON THE PROPOSED CHANGES TO THE RULE, THE INFORMATION COLLECTION REQUIREMENTS CONTAINED IN SECTIONS 24 CFR 905.204 (F) (3) AND (G) ARE APPROVED. THESE REQUIREMENTS GROW OUT OF A CONSENT DECREE ENTERED INTO BY HUD EARLIER THIS YEAR AND, AS SUCH, ARE APPROVED. THE REMAINING INFORMATION COLLECTION REQUIREMENTS APPEAR TO GO BEYOND THAT REQUIRED BY THE CONSENT DECREE AND DO NOT SEEM THE LEAST BURDENSOME NECESSARY TO IMPLEMENT THE ACT AND THE CONSENT DECREE AND A THUS DISAPPROVED. HUD MUST RESUBMIT THIS INFORMATION COLLECTION REQUEST WHEN THE RULE GOES FINAL, AND ANY CHANGES FROM THE APPROVED INFORMATION COLLECTION REQUIREMENTS NEED TO BE FULLY JUSTIFIED. WE ARE CONTINUING THE BURDEN AT ITS CURRENT LEVEL PLUS 1 HOUR FOR THE PROPOSED RULE'S APPROVED INFORMATION COLLECTION REQUIREMENTS.

Abstract: THE PROPOSED RULE IMPLEMENTS SECTION 7(B) OF THE INDIAN SELF-DETERMINATION AND EDUCATION ASSISTANCE ACT WHICH REQUIRES THAT PREFERENCE BE GIVEN TO INDIAN ENTERPRISES AND ORGANIZATIONS IN CONTRACTING AND SUB-CONTRACTING AND TO INDIANS IN EMPLOYMENT AND TRAINING. THE REPORTING REQUIREMENTS IN THE PROPOSED RULE ARE FOR MATERIAL THAT CONTRACTORS MUST SUBMIT TO ENSURE THAT THE PREFERENCES ARE PROVIDED.
