Abstract: SECTION 966.41 PROCEDURE FOR HUD DETERMINATION (ON STATE AND LOCAL EVICTION PROCEDURE THE PHA MAY EXCLUDE EVICTION OR TENANCY TERMINATION GRIEVANCES FROM IT ADMINISTRATIVE PROCEDURE IF HUD HAS AUTHORIZED THE PHA TO DO SO. HUD FIRST MUST MAKE A DETERMINATION THAT STATE AND LOCAL LAW EVICTION PROCEDURES PROVIDE THE TENANT WITH THE BASIC ELEMENTS OF DUE PROCESS.
