THE COAST GUARD IS RESPONSIBLE FOR
ENFORCING THE MARINE SANITATION DEVICE (MSD) REQUIREMENTS OF
SECTION 312 OF THE FEDERAL WATER POLLUTION CONTROL ACT. STATES ARE
PREEMPTED FROM ENFORCING THE MARINE SANITATION DEVICE REGULATIONS.
STATES, HOWEVER, FORWARD THE DETAILS OF VIOLATIONS TO THE COAST
GUARD FOR PROCESSING OF A VIOLATION AND ASSESSMENT OF A CIVIL
PENALTY.
