the following conditions: 1)OMB understands from FERC staff that 18
CFR 16.16(c)(2) doesn't require a licensee to transfer o store the
required information at a single location, but if asked to provide
information at a central point, it must do so, and 2) 18 CFR
16.16(d)(1) & the "compile" requirement in (c)(1) are not
approved. Sections (d)(1) & (c)(1) would require all licensees
to review all the files, determine whether the information exists
& is covered by the regulations, and then catalog it in advance
of any request by the public. If any information is then found
"unavailable" (missing, too fragile, illegible, etc.), the licensee
must inform FERC so that it can investigate the claim. FERC staff
argue that information is not "available" to the public if its
existance or readability cannot be demonstrated in advance of any
request for it. OMB does not find this sufficient justification for
requiring all licensees to inventory existing information and
believes that the statutory intent of providi public access is
satisfied by requiring a licensee to provide the information when
requested. At that time the licensee can determine th existance and
availability of the document (within a reasonable period of time)
and provide it to the public. If the public believes the
information is available but is being withheld, it can petition
FERC for assistance as provided under 18 CFR 16.16(d)(2).

THE INTERIM RULE (RM87-7) REQUIRES THE
COMMISSION TO CARRY OUT THE REQUIREMENTS OF SECTION 8 OF THE
ELECTRIC CONSUMERS PROTECTION ACT OF 1986 (ECPA) CONCERNING THE
LICENSEE MAKING INFORMATION REGARDING CONSTRUCTION AND OPERATION OF
THE LICENSEE PROJECT READILY AVAILABLE TO THE PUBLIC.
