Terms of Clearance: This proposed data collection is disapproved as it does not meet the requirement in 5CFR1320.4 that it have practical utility. MSPB has not demonstrated how this information can be used in weighing the personal privacy consequences of disclosure against the public interest represented by the act of disclosure. Further, the pending decision in the case, Reporters Committee for the Freedom of the Press vs. Department of Justice, will provide additional guidance in making disclosure determinations.
