Abstract: WHENEVER THE DATA ON COLOR ADDITIVES FAILS TO SHOW THAT IT WOULD BE SAFE TO LIST TH FOR ALL THE USES PROPOSED, THIS REGULATION AUTHORIZES THE COMMISSIONER TO PUBLISH IN A FEDERAL REGISTER NOTICE THAT IT IS NECESSARY TO ALLOCA THE SAFE TOLERANCE FOR THE STRAIGHT COLOR IN THE COLOR ADDITIVE AMONG THE COMPETING NEEDS. THE NOTICE SHALL CALL FOR THE PRESENTATION OF DA IN ACCORDANCE WITH SECTION 706(B)(8) OF THE ACT.
