Abstract: THE PROPOSED REGULATIONS ALLOW U.S. TAXPAYERS RELIEF FROM POTENTIAL WITHHOLDING LIABILITY ON SWAP CONTRACTS WITH FOREIGNERS BY ELECTING TO APPLY THE RULES RETROACTIVELY. THE ELECTION ALSO RESULTS IN THE U.S. TAXPAYER EARNING U.S. SOURCED INCOME. THE ELECTION WILL AFFECT ALMOST EXCLUSIVELY THE CORPORATE COMMUNITY. IT IS NEEDED TO RESOLVE A DIFFICU ISSUE UNDER OLD LAW.
