Abstract: FEDERAL REGULATIONS ALLOW MANUFACTURERS TO MARKET HEAVY-DUTY ENGINES AND VEHICLES WHICH FAIL TO MEET CERTAIN EMISSION STANDARDS(S) UPON PAYMENT OF A NONCONFORMANCE PENALTY (NCP). CALIFORNIA PLANS TO IMPLEMENT AN NCP PROGRAM UNDER WHICH IT WOULD COLLECT THE NCP. THE PROPOSED AMENDMENT TO THE FEDERAL REGULATIONS WOULD WAIVE COLLECTION OF THE FEDERAL NCP IF A CALIFORNIA NCP WERE PAID.
