This ICR covers
three elements: (1) the State Primacy application requirement under
the Safe Drinking Water Act, (2) grant applications, and (3) States
seeking primacy for the first time. OMB is taking the following
actions with respect to each. (1) proposed rule - not approved. EPA
needs to develop better burden estimates especially for the major
information requirements (i.e. Stat attorney general statements and
regulatory development), so that, the practical utility can be
assessed and justified compared with the need to minimize burden
(see 5 CFR 1320). EPA needs to add a discussion of any quarterly
reporting requirements to States for making the required conforming
changes so that more "bundling" can be utilized by States t
minimize burden without sacrificing the needs of EPA to assure
State compliance, which historically has been quite good. In the
final ICR, EPA shall summarize the major public comments received
that pertain to the rule's burden and indicate how they have been
addressed. (2) grants - approved as is (9,360 hours). (3) first
time primacy - approved, but for less hours than requested (520 vs
1040) since only one state is likely to apply for primacy in the
nect two years. This ICR is approved until 9/90 when the "base" PWS
ICR expires and these incremental burdens would be merged with it,
although discribed separately. Earlier comments for this OMB number
still apply.
