Terms of Clearance: Disapproved. This request requires greater programmatic justification and a demonstration that the application is consistent with the intent of IRCA. Regarding IRCA, it is not clear whether and the extent to which the "Application for Employment Aurthorization" and the attendant identity document would be construed as a "change" in the existing employment verification system (see Section 274(A)(b)(1)(C)(iii) and 274(A)(d)(3)(A)), or as a "national identification card" under Sec. 274(A)(c) and meets the specific requirements in 274(A)(d)(2)(C), (D), (E) and (G). OMB also questions whether there has been adequate INS consultation within the Department of Justice, and with other concerned agencies and the public (perhaps through a Federal Register notice), with respect to such issues as hiring discrimination based on national origin or citizenship status. In addition to needed public notice and comment, any supporting justification needs to evaluate the relation of the proposed application to other employment related information collections (e.g., the I-9) and demonstrate that the proposed application and identification instrument will also be fully justified by savings in burden on employers, applicants, and the public.
