Terms of Clearance: We have filed the following comments on the collection of information on this proposed standard: 1) Pursuant to 5 CFR 1320.4(b)(1), OSHA shall ensure that the collections of information associated with updating of "entry permits" is the least burdensome necessary. Unless, OSHA can demonstrate that the maximum time period, for which entry permits are valid, must be limited to one year, OSHA shall require that permits be valid as long as they correctly address the hazardous conditions existing in the confined space. 2) Pursuant to 5 CFR 1320.4(b)(2), OSHA shall ensure that the collections of information of this standard do not duplicate those required in 1910.147, "The Control of Hazardous Energy (Lockout/ Tagout)." Because work within a confined space could fall within the jurisdiction of both rules, OSHA shall consider explicitly allowing employers to adapt written procedures/permits to meet the safety requirements of both rules. 3) Pursuant to 5 CFR 1320.4(b)(1 and 3), OSHA shall examine more fully the burden which the written permits impose on small businesses and alternatives for reducing that burden, such as oral communication. When the information collections in the final rule are submitted fo PRA review, OSHA shall place the OMB comment number (1218-0159) in ite 20 on the SF83. OMB is not providing an approval number at this time.
