Terms of Clearance: The agency failed to submit this collection of information to OMB on or before the date of publication of the NPRM in the FEDERAL REGISTER (as required in 1320.13(b)). Hence, the OMB comments filed herein are for agency guidence only. We shall review the paperwork requirements in the final rule in their entirety when submitted for review. ** In the final rule, MSHA shall demonstrate that the collections of information associated with the "written decontamination, disposal, and emergency procedures" provide practical utility and are not duplicative of CFR 57.11053, and possibly CFR 77.1101, and are consistent with CFR 48.31 and CFR 75.161, and other written emergency plans required by MSHA for both surface and underground mine In submitting the final rule to OMB for review under the PRA, MSHA should make reference to the OMB comment number, 1219-0109, (it should be placed in item 20 of the SF83). OMB is not providing an approval number at this time.
