Terms of Clearance: The agency failed to submit this collection of information to OMB on o before the date of publication of the NPRM in the FEDERAL REGISTER (as required in 1320.13(b)). Hence, the OMB comments filed herein are for agency guidence only. We shall review the paperwork requirements in the final rule in their entirety. We are filing comments on the proposed collections of information 70.1900(d) and 70.1901(g) under 5 CFR 1320.4(b). In setting up the criteria for personal monitoring, MSH had created a potentially (unnecessarily) burdensome paperwork require ment. Currently, personal monitoring is cancelled if exposure is less than 75 percent of the PEL -- but, is triggered again if exposure is greater than 50 percent of the PEL. For those mining environments operating at at levels between 50 and 75 percent of the PEL, a a burdensome paperwork loop will be created (as the mine falls under the requirements of area monitoring one week, then personal monitoring the next week, and so on). When the information collections in the final rule are submitted for PRA review, the agency shall place the OMB comment number 1219-0111 in item 20 on the SF83. OMB is not number at this time.
