OIRA is not
approving this collection at this time. The maximum review period
for this collection expires tomorrow, December 12, yet there remain
two outstanding issues. First, on November 8, OIRA suggested that
EPA require ground-water monitoring data for units where there is
known contamination (for instance, if the unit has ever fallen
under the requirements of 40 CFR 264.98(h)) or, otherwise, require
the petitioner to list units where the waste has been disposed and
certify that no contamination has been detected. EPA declined to
accept this suggestion on December 6. This issue deserves further
consideration since it would significantly reduce the burden placed
on respondents, yet it is unclear how it may affect the delisting
process. . Second, at leat one commenter questioned EPA's burden
estimate of 31 hours per respondent, claiming it is too low. EPA
has not had adequate time to address this issue.

PETITION CONTAINING THE NECESSARY INFORMATION. THE AGENCY ALSO
