This ICR for the
proposed "Phase II" Drinking Water Regulations for th Synthetic
Organic Chemicals is not approved because EPA failed to subm the
ICR to OMB until four months (September 15) after the proposal's
publication (May 22, 1989) as required by 5 CFR 1320.13 (b) &
(d). In addition, EPA should seriously examine the following ways
to reduce burden and still fulfill EPA's data needs: (1)
compositing of samples, (2) replacing annual monitoring with peak
vulnerability monitoring, (3) making monitoring frequency
reductions automatic rathe than requiring an affirmative State
action, (4) reducing the monitorin period for collecting baseline
data (e.g. three years to one year), (5 the analytical methods
necessary for monitoring the unregulated contaminants and whether
that technique is required elsewhere, and (6) the need for
quarterly State reports on all lists in the rule. This ICR should
be combined with the Phase II Inorganics ICR at final with the one
time burden from the monitoring of unregulated contaminan in the
first year estimate (not spread out over time) and EPA shall place
OMB comment number 2040-0090 in item 20 on the SF 83. The ICR f the
final rule should also explain in more detail how the burden
estimates were derived (i.e. labor rates and burden of sample
analysis In summary, OMB is also disapproving the collection under
5 CFR 1320 because EPA has not demonstrated that the collection is
the least burdensome necessary for the proper performance of EPA's
functions.
