Terms of Clearance: In accordance with the Paperwork Reduction Act and 5 CFR 1320, OMB cannot approve this survey. EPA has not demonstrated that the information requirements have practical utility and are the least burdensome necessary to achieve agency objectives. For example, the supporting statement does not explain how EPA intends to use this data other than generalizing that it will be used as background materi for several agency initiatives. To demonstrate practical utility, EPA should describe in detail current policy objectives, how gaps in the available information prevents EPA from carrying out those objectives and how this collection will correct these problems. Also EPA should explain why it is necessary to collect this information from all facilities constructed after 1975 rather than a sample of facilities. EPA should also review how the recent Appeals Court decision in WEPCO v. Reilly affects EPA's policy on life-extention projects and what affect, if any, that decision will have on this information collection. EPA should also consider how this information would be used if the Administration's proposed amendments to the Clean Air Act are enacted. EPA should also reevaluate the estimated burden given the large volume of public comments on the issue.
