However, we continue to have serious reservations concerning
whether a person can be said to have violated a law without having
been convicted as implied in the narrative justification. The
justification states, "as noted in the emphasized language, a
permit can be suspended for violations of certain laws without
those violations resulting in a conviction" (additinal
justification, p. 2, 9th line from the bottom). Also, we question
whether an arrest is evidence of violation of a law as implied by
the statement, "both Federal and State arrests and convictions are
asked for because such a violation of a soverign's laws
demonstrates a person's law-abiding character in general"
(additinal justification, p. 3, l. 7). The Department should ensure
correction of the Paperwork Reduction Act notice to request that
comments be sent both to BATF and OMB.
