Terms of Clearance: This ICR for the proposed acquisition regulations concerning conflict interest (COI) is not approved because the agency has not demonstrated that the collection is the least burdensome necessary for the proper performance of the agency's function (5 CFR 1320.4(b)(1)). In particular, EPA shall consider exempting additional non-discretiona services beyond those identified in the rule. Also, the certification requirements appear unnecessarily burdensome if applied to all employees. EPA shall provide better justification of its burden estimates including per respondent burden of 30 to 40 hours and the exclusion of customary business practices which cuts the burden in hal In general, EPA should explain why special COI procedures are needed for Superfund contracting and the need to include "potential" COI. The final ICR shall address the public comments on the rule and ICR in detail and place OMB comment number 2030-0023 in item 20 on the SF-83. OMB is not providing an approval number at this time.
