We remain
unconvinced that question 5 has public utility to the agency The
statutory references to which the agency points are meant to punis
payees who have committed fraud in order to receive these funds. We
ha discovered no reference which prohibits any person who has
committed any other felony (other than those acts listed at 42 USC
408 and 42 USC 1383) from becoming a payee. We therefore do not
approve use of question 5 in its present form. All other questions
are approved, and the agency may wish to resubmit a re-phrased
version of question 5 if it wishes.
