Terms of Clearance: The Agency should reevaluate the reporting and recordkeeping requirements to ensure the least burdensome approach necessary to achieve program goals of enhanced oversight. Because FNS, in proposing this rule, failed to comply with OMB regulations requiring the solicitation of comments to be filed with OMB (5 CFR 1320.13(a)) or to provide the public with an estimate of the total and disaggregated burden of the rule's requirements (5 CFR 1320.15(a)), OMB is unable to fully assess the burdensomeness of the proposal. The Agency should address this comment on minimizing burden in submitting the text of the final rule to OMB for approval under the Paperwork Reduction Act prior to its publication.

Abstract: THE PROPOSED FOOD DELIVERY REGULATION WILL PRIMARILY STRENGTHEN AND IMPROVE VENDOR MANAGEMENT AND FOOD INSTRUMENT ACCOUNTABILITY IN THE SPECIAL SUPPLEMENTAL FOOD PROGRAM FOR WOMEN, INFANTS AND CHILDREN (WIC IT ADDRESSES SELECTION, TRAINING HIGH-RISK IDENTIFICATION, AND SANCTIONING OF VENDORS AND DUAL PARTICIPATION, RECONCILIATION, PARTICIPANT SANCTIONS AND FOOD INSTRUMENT SECURITY.
