Because the
agency considers the requirements of 29 CFR 1917.23, .24, .25, and
.116 as exempt from Paperwork Reduction Act Review, we have neither
reviewed nor approved these requirements. We have, however,
approved the information collection requirements that remain in
this paperwork submission, requirements pursuant to 29 CFR 1918 and
1919. Approval is given, however, for only one year because the
Department has not complied fully with the existing terms of
clearance: "The agen shall initiate and complete rulemaking by the
date of expiration of th approval." While OSHA acknowledges that
rulemaking should be undertake to revise the reporting requirements
at 29 CFR 1919.13(b) and 1919.11( and (f), it has not commenced
this action. Before the next submission, the agency shall discuss
this action in the Regulatory Agenda and/or Program, or fully
justify why it has not done so. Because we have give a less than
three year approval for this package, the agency need not print an
expiration date on the OSHA 70, 71, and 72, as required at 5 CFR
1320.4.
