Terms of Clearance: This information collection request is not approved, in light of the significant public comments received by OMB regarding potential increases in administrative burden for institutions proposed by ED's NPRM. ED shall respond to these comments in the final "Immigration Status Confirmation" regulation preamble. This response shall either revise the sections containing paperwork burden, or justify the NPRM provisions in light of both public comment and the Paperwork Reduction Act standard that Federal paperwork burden be minimized. Significant comments include: -- The imposition of burden for secondary confirmation on institutions when a student can obtain such documentation directly from INS and/or through ED's Central Processor. This is consistent with the PRA, whic states that an agency shall "eliminate ... collections which seek to obtain information available from another source within the Federal Government." -- The imposition of a 10-day time limit in which an institution must process the paperwork necessary for secondary confirmation (668.135). -- The imposition of secondary confirmation responsibility on institutions without determining whether primary confirmation was not attained due to Federal data error, for students with prior records. -- The requirement that institutions establish written policies and procedures for secondary confirmation, rather than meet ED guidelines.

Abstract: THESE REGULATIONS ARE BEING PROPOSED FOR THE PURPOSE OF REDUCING THE POTENTIAL OF FRAUD AND ABUSE IN TITLE IV, HEA PROGRAMS CAUSED BY INELIGIBLE ALIENS RECEIVING FEDERALLY SUBSIDIZED STUDENT FINANCIAL ASSISTANCE.
