Terms of Clearance: OMB cannot approve the request for approval of the proposed revised I-485 in its present form at this time. We are returning the request and continuing the existing I-485 (OMB #1115-0053) until 6/30/92. With respect to proposed changes, OMB requires further information or justification to support a format in Part III that requires "Yes" or "No" answers to each of 14 questions relating to grounds for exclusion. An improved format, in OMB's view was adopted in December 1990, for INS Form I-821 (Temporary Protected Status Eligibility Questionnaire). In OMB's review, there were also concerns regarding identification past practice of polygamy in Part III (questi 4a). We will require further justification if questions depart from statutory grounds of exclusion regarding activities that may be legal outside the United States. In addition, other questions (1b) regardin arrests and charges outside the U.S. appear to go beyond statutory requirements of exclusion and related questions that are more circum- scribed on other forms (I-821) which relate to criminal convictions.
