Terms of Clearance: This ICR for the proposed reporting and recordkeeping requirements associated with the Phase I Oil Pollution Prevention regulations is no approved. EPA has failed to adequately justify the scope of the reporting requirement for various facility types (e.g. farms, electric substations, mines, and facilities that store food oil) as the least burdensome to carry out to program enforcement objectives (see 5 CFR 1320). EPA should also justify the need for a census of facilities rather than a less burdensome, targeted survey. Aside from the above concerns on the respondent population, the specific information requested of a respondent appears to be the least burdensome to meet enforcement needs. If EPA needs to collect additional information concerning various facility types to assess the merits of the rule's scope prior to promulgation of the final rule, then OMB will consider an expedited paperwork review. The level of detail and type of information for this assessment may need to be greater to fulfill the regulatory evaluation objective than the proposed facility census for enforcement purposes.
