Abstract: WE NEED TO KNOW STATE LAWS, RULES, AND OTHER MEASURES THAT MAY CONFLIC WITH NON-DISCRIMINATION OBLIGATIONS OF THE INVESTMENT CHAPTER OF THE DRAFT NAFTA AGREEMENT. KNOWING IN ADVANCE SUCH MEASURES AND RECORDING THEM IN AN ANNEX TO THE AGREEMENT WILL ENABLE THE U.S. TO EXEMPT SUCH MEASURES FROM THE NAFTA OBLIGATIONS.
