Terms of Clearance: This information collection is not approved because it does not fully conform to the requirements of the Paperwork Reduction Act (PRA) and 5 CFR 1320. Under Section 1320.6(f), General Information Collection Guidelines, the rule states that the "OMB will not approve a collectio of information" which requires "respondents to retain records, other than health, medical, or tax records, for more than three years." In this case, ITC has failed to justify the need to collect five years worth of data. The first two years of collection would prove to be ve burdensome for the respondents who may not have retained historical records necessarily to comply with the proposed request. In light of the potential difficulty in gathering and providing accurate informati in the first two years, ITC has not clearly justified the statistical validity and practical utility of that aspect of the data collection effort. ITC should review the requirements of Section 1320.20 of the PRA if it chooses to exercise its authority to override OMB's disap- proval by a majority vote of its commissioners.
