Abstract: SECTION 427 OF THE SOCIAL SECURITY ACT (THE ACT) PROVIDES FOR INCENTIV PAYMENTS TO STATES WHICH MEET SPECIFIC FOSTER CARE PROTECTIONS. AMONG THESE PROTECTIONS IS THE IMPLEMENTATION AND OPERATION OF A WRITTEN "CASE PLAN" THAT DESCRIBES THE HOME OR INSTITUTION OF THE CHILD, THE APPROPRIATENESS OF SUCH PLACEMENT, AND ASSURES SUCH PLACEMENT IS IN TH LEAST RESTRICTIVE SETTING.
