Abstract: THIS REGULATION PROVIDES THAT, UNDER CERTAIN CIRCUMSTANCES, COST OF LIVING BENEFIT PAYMENTS CAN BE MADE TO PRE-1977 RETIREES WITHOUT SUCH PAYMENTS BEING CONSIDERED EITHER A PENSION PLAN OR A WELFARE PLAN UNDER ERISA, SUCH PAYMENTS MUST BE ACCOMPANIED BY A WRITTEN NOTICE.
