Abstract: UNDER CERCLA NO. 119, EPA HAS THE AUTHORITY TO INDEMNIFY RESPONSE ACTI CONTRACTORS (RACS) FOR DAMAGES ARISING FROM NEGLIGENT ACTIONS THAT CAU THE RELEASE OF HAZARDOUS SUBSTANCES FROM A FACILITY. BEFORE EPA MAY INDEMNIFY A RAC, HOWEVER, THE RAC MUST MAKE A DILIGENT EFFORT TO LOCAT INSURANCE.
