Abstract: RULE 17F-6, WHICH WOULD PERMIT INVESTMENT COMPANIES TO USE FUTURES COMMISSION MERCHANTS ("FCMS") AND COMMODITY CLEARING ORGANIZATIONS AS CUSTODIANS, WOULD REQUIRE A WRITTEN FCM CONTRACT TO CONTAIN CERTAIN PROVISIONS. FUND BOARDS COULD DELEGATE THEIR DUTY TO SELECT AND MONIT FCM ARRANGEMENTS BY ADOPTING WRITTEN GUIDELINES GOVERNING THE DELEGATE RESPONSIBILITIES.
