This ICR for the
proposed plant pesticide regulation and related exemptions is not
approved. EPA has failed to demonstrate that the information is the
least burdensome necessary, as required by 5 CFR 1320.6. In the
proposed rule and associated tolerance exemptions, EPA has proposed
several categories of plant pesticides that would be excluded from
coverage and thus any reporting requirements. However, EPA is
working to develop other exemptions for low risk plant pesticides
that could further reduce the public comments on additional
exclusions (e.g., viral sequences) and develop the least burdensome
final rule possible given the additional burden for special
labeling of plant pesticides. If the labeling requirements change,
EPA will need to modify the ICR. In addition, for the final rule
ICR, EPA should use testing burdens that are consistent with OMB
guidance at that time (ICR assumes one third of total testing cost
is an information collection burden).

THE PROPOSED REGULATION UNDER FIFRA
INTERPRETS PESTICIDAL SUBSTANCES PRODUCED BY PLANTS AS
"PLANT-PESTICIDES" AND DEFINES THE SCOPE OF REGULATION. PRIOR TO
REGISTRATION OF A PLANT-PESTICIDE, THE MANUFACTURER MUST
DEMONSTRATE TO EPA THAT THE USE OF THE PESTICIDE PRODUCT WILL NOT
RESULT IN ANY ADVERSE EFFECTS TO HUMANS OR THE ENVIRONMENT. THIS
PROPOSAL OUTLINES AND CLARIFIES REGULATORY RESPONSIBILITIES OF THE
MANUFACTURER AT DIFFERENT STAGES OF FIELD TESTING THROUGH
REGISTRATION OF THE PESTICIDE.
