This ICR
associated with the proposed Phase III Land Disposal Restrictions
is not approved. The existing approval for other reporting
requirements under OMB control number 2040-0042 continues. In the
Phase III proposed rule, EPA requested comment on several de
minimis approaches which may reduce the information collection and
recordkeeping burden on certain operators of undertround injection
wells. However, the ICR did not calculate the different burdens of
these alternative approaches. Since EPA has not demonstrated that
the proposed option in this ICR is the least burdensome approach
(see 5 CFR 1320.4(b)(1)), this ICR is not approved.
