Taking of marine mammals is prohibited by the Marine Mammal Protection Act. Takings can be authorized for specific activities provided that NOAA determines that the taking will have negligible impact on marine mammals and subsistence needs. The information requested from applicants for authorizations allows NOAA to make required determinations and thereby waive the moratorium.
