The Endangered Species Act imposes, with certain exceptions, prohibitions against the taking of endangered species. Section 10 allows citizens to incidentally take listed species if they apply for a general permit and/or a certificate of inclusion. Without a permit, takings are prohibited and citizens are subject to prosecution. In order to apply, certain information must be furnished.
