Terms of Clearance: This is a new collection based on a recently completed rule- making. The FCC will promulgate specific guidance to LECs after determining that a Represcription of Rate of Returns is required. FCC will provide OMB with copies of these materials. FCC will also notify OMB of requirements for electronic filing and expected percentage of materials that will be filed in this fashion.

Abstract: The Order revises the part 65 rules governing the procedures and methodologies for prescribing and enforcing the rate of return for certain LECs. Specifically, the Order replaces the existing rule, which initiates represcription proceedings biennially, with a semiautomatic trigger activated by changes in capital cost; modifies the paper hearing rules set out in part 65; streamlines the methodologies used to estimate the cost of capital; and removes the automatic refund rule.
