Terms of Clearance: This collection is not approved at this time. DOL changes of 2/16/96 and 2/21/96 accepted. In the final class exemption, DOL shall address the following issues: (1) DOL will respond to public comments regarding ways to minimize burden, maximize utility and prevent duplication by revising the final exemption as appropriate or providing justification to why such revisions were not made. (2) DOL will respond to comments regarding the time period for authorization as well as the required elements in the application. (3) DOL will respond to comments regarding the public burden estimates on the respondent. In addition, DOL is encouraged to explore optional formats to file an application, such as an optional simplified form. DOL will also emphasize ease of use by employers and pension plan administrators in the final class exemption. This collection is acted on today due to the extended government shutdowns.

Abstract: Certain parties in interest in ERISA-covered pension and welfare benefit plans have the opportunity to seek approval on an accelerated basis of otherwise prohibited transactions by providing the Department and interested persons with information demonstrating that the proposed transaction is substantially similar to at least two individual exemptions previously granted and, in some cases, show that the interests of participants and beneficiaries are adequately represented and protected by an independent fiduciary.
