Terms of Clearance: OMB does not approve this package. OMB is concerned about the accuracy of the cost and hour burden estimates, as well as whether the proposed scheme for retaining records to support nutrient content and health claims has utility. When the the package is re-submitted for approval at the final stage the agency will address OMB's concerns and the public comments received on these issues in the preamble of the final rule and in the paperwork submission package.

Abstract: The Nutrition Labeling and Education Act of 1990 provides that nutrient content and health claims may be used on the label of a food if the claim is made in accordance with regulations issued by FDA. Proposed 101.13(r) and 101.14(h) would require that persons making certain nutrient content and health claims maintain and make available to regulatory officials the records that are the basis for the claim.
