OMB files comment on the information collection provisions contained in this proposed rule, and continues the current PRA clearance of the existing regulation through 9/97. In drafting its final regulation, DOL shall assess and discuss in its preamble its responses in light of the following comments, all of which concern ways to maximize usefulness, minimize burden, and prevent duplication in this rule. DOL's responses on these issues shall also be made in the context of other public comments received on the proposed rule. DOL shall: 1. review the current list of industry exemptions to determine the utility and reduced burden of expanding this list, as discussed in the NPRM preamble; 2. reexamine the need for repeating questions on two forms, the 300 and the 301, given State workers' compensation forms that may provide similar information and be sufficient to allow DOL to move to a single form, as discussed in the NPRM preamble; 3. consider carefully the level of access to logs in light of privacy considerations, and whether the level of access proposed maximizes utility, as discussed in the NPRM preamble; 4. review its proposal for recordability in light of public comments received; 5. determine whether the proposed definition of "establishment" minimizes burden and maximizes clarity; 6. assess the utility of requiring annual postings of hours worked to determine the rate calculation; and 7. review and discuss other substantive issues raised in public comments that address burden, utility, or duplication involved in the proposed rule.

The OSH Act prescribes that there must be an effective program for collection, compilation, and analysis of occupational safety and health statistics. The data are needed by OSHA and BLS to report on and carry out enforcement of standards to guarantee workers' safety and health on the job. Approximately 620,000 establishments will be required to maintain records.
