collection is approved through 5-97 under the following conditions:
Upon the next submisstion, HCFA will submit a proposal to
streamline the home and community-based waiver process for States.
Initiatives to streamline the process could include: facilitating
the electronic transmission of the form, creation of a preprint
with simple response boxes, modification of regulations to create
permanent authorities and elimination of the need for waivers of
specific provisions. In the event that legislation modifying the
waiver process is passed before 5-97, HCFA will submit the modified
information collection to OMB upon completion. HCFA failed to
respond to previous terms of conditions and as a result OMB will
not review any submission that does not address these terms and
include either changes or a proposal to streamline the
process.

Under a Secretarial waiver, States may
offer a wide array of home- and community-based services to
individuals who would otherwise require institutionalization.
States requesting a waiver must provide certain assurances,
documentation, and cost and utilization estimates which are
reviewed, approved, and maintained for the purpose of
identifying/verifying States' compliance with such statutory and
regulatory requirements.
On behalf of this Federal agency, I certify that

1320.8(b)(3).
