This R&O and
NPRM begins the rulemaking for Open Video System operation and
regulation as defined by the Telecomms Act of 1996. As such, the
item lays out broadly proposed information collection activities:
a) how operators would notify video providers of its intent to
establish a system; b) how the FCC would enforce rates and terms
for carriage of programming on such Open Video Systems; c) how
Video Programming Providers or Copyright holders would identify
programming to subscribers; d) how operators of Open Video Systems
would certify to the FCC compliance with Section 653 of the
Telecommunications Act; and e) how the FCC would operate a dispute
resolution process that addresses program access disputes. The FCC
will revise this collection as these activities are issued as final
rules.

The Commission, in Report and Order
and NPRM, Implementation of Section 302 of the Telecommunications
Act of 1996, seeks to develop a record to enable determination of
what rules, if any, need to be adopted to effectuate the statute's
requirements. A potential open video system (OVS) operator must
notify video programming providers if it intends to establish an
open video system. The Commission therefore seeks comment on what
procedures the OVS operator should follow, the proper form and
scope of such notice, and the appropriate publication
requirements.
