the substance of the rulemaking -- and the issue of Federal
preemption of State and local restrictions on antennas and the
FCC's authority over non-governmental entities such as homeowner's
associations. One comment was received citing the potential cost
burden to local governments should they seek a waiver. These
comments were mostly directed at the substance of the rulemaking
and the Telecommunications Act of 1996 intent.

Pursuant to the Telecommunications Act
of 1996, the Commission proposes rules prohibiting restrictions on
viewers' ability to receive over-the-air signals, by presumptively
preempting state and local regulations that could impair viewers'
ability to receive such signals. State and local governments may
demonstrate the reasonableness of their regulations by filing
requests for declaratory rulings or petitions for waivers with the
Commission. These filings constitute the information collection
foreseen by the Commission.
On behalf of this Federal agency, I certify that
