These revisions
to the NSR and PSD program ICR are not approved under 5 CFR
1320.11. EPA has failed to document in adequate detail that the
proposed revisions are the least burdensome necessary for the
proper performance of the Agency's functions, and have practial
utility. To address this, the agency shall, in the final ICR, AND
in the preamble to the final rule (5 CFR 1320.11(f): -provide a
more detailed analysis of the numbers of sources likely to be
affected under the reformed NSR/PSD provisions; -provide a more
detailed analysis of the change in recordkeeping and reporting
burden due to these reforms including, for example, an item by item
description of reform actions, the number of affected entities for
each, and the resulting change in burden associated with each
change. EPA should provide support for each burden change estimate
it relies upon, carefully documenting the source of such estimates.
-provide an especially detailed assessment of burden changes due to
changes to requirements for sources locating near Class I areas and
PAL and Clean Facility Exemption provisions. EPA shall address
these comments and other public comments received on this ICR in
the preamble to the final NSR/PSD Reform rulemaking, as per 5 CFR
1320.11(f). In that final rule, EPA shall comply with the
requirements of 5 CFR 1320.5(a) that a statement be published with
the preamble to the final rule stating that the ICR has been
submitted to OMB for review, the time period for OMB review and
public comment, that comments on the ICR requirements should be
submitted to EPA and OMB (with appropriate addresses provided), a
detailed description of the likely respondents and a summary of the
burden estimate.

This information collection request
addresses the recordkeeping and reporting burden to the Federal
Government, industry respondents, and State and local agencies
subject to preconstruction review and permitting requirements under
40 CFR 51 and 52 and the Clean Air Act Amendments of 1990. Burden
estimates are calculated for the 3-year period beginning January
1998 and ending January 2001.
