Terms of Clearance: The information collection requirements contained in the GA cost allocation plan proposed rule are not approved at this time. ED has received public comment on this NPRM regarding the substantial burdens that submission of this plan will place on GAs, as well as the commenters' belief that ED's estimate of 1 hour for annual burden is significantly understated. In the preamble to the final rule, ED shall address this concern in a way that minimizes burden and provides accurate estimates of that burden. ED will resubmit the final rule for PRA clearance.

Abstract: A guaranty agency is a State or private nonprofit entity that performs certain administrative roles in the FFEL program. Their reserve funds contain Federal money. Some agencies are involved in separately funded non-FFEL guaranty activities. If such an agency uses personnel and resources to perform both its FFEL and other activities, it must develop and comply with a plan for allocating costs to ensure that Federal funds are not used to subsidize the agency's non-FFEL guaranty activities. The agency will be required to submit its cost allocation plan to the Secretary upon request.
