This ICR is
approved under 5 CFR 1320 for three years and 997,222 hours per
year. This burden estimate includes 3 hours of recordkeeping for
300,000 pesticide applicators. Following publication in the Federal
Register of a notice of revision of this ICR and a period of public
review, and following submission of this ICR to OMB for its review,
EPA prepared re-estimates of the burden and EPA reduced the burden
by 990,000. EPA based this reduction on information collection
activity burdens that it concluded were exempted under 5 CFR 1320.
EPA has not adequately supported this re-estimate, and the basis
for concluding the recordkeeping in question is "usual and
customary." Furthermore, EPA's revised estimate has not been made
available for public review as required under 5 CFR 1320.8. EPA may
submit to OMB another revision to the reporting burden of the ICR
at any time. The supporting statement for such a reduction request
shall include evidence of the information applicators collect as
part of the normal course of their business activities. EPA shall
also provide the names and telephone numbers of currently regulated
applicators that EPA has consulted with so OMB can evaluate such
evidence.

The Federal Fungicide, Insecticide,
and Rodenticide Act requires pesticides to be classified as general
or restricted use. Restricted use pesticides can only be used by or
under the supervision of a certified pesticide applicator.
Approximately one million farmers (private applicators) and 350,000
commercial applicators are using restricted use
pesticides.
