Terms of Clearance: OMB has concerns with this rulemaking which will be taken up in E. O. 12866 review when the draft final rule is submitted to OMB for review. With respect to the information collection request, we believe it would be difficult for commentors to make meaningful comments on the November 21 notice, absent knowledge of the substance of the final rule. The rule as drafted provides for a final rule with opportunity for punlic comment on the information collection requirements. If the rule were issued as drafted, OMB would like to review agency responses to public comments before taking final action on the information collection requirements.

Abstract: This rule allows relief to air carrier operators to operate their airplanes with previously approved seats if the applicant can show that the seats meet new and improved airworthiness requirements. The burden of obtaining FAA approval of data developed by seat manufacturers rests with the air carriers.
