future, HCFA expects to make fundamental amendments to these
underlying HHA surety bond rules. These amendments will address
issues such as cumulative liability and due process raised by the
surety bond industry in public comment. Upon publication, OMB
expects that HCFA will submit these revised final rules for
emergency PRA clearance.

Section 4312(b) and 4724(b) of the
Balanced Budget Act of 1977 (Pub. L. 105-33) requires each
Medicare/Medicaid participating HHA to secure a surety bond in
order to participate in the program.
On behalf of this Federal agency, I certify that
