This ICR, which amends the information collection under OMB 2050- 0073, is approved. EPA is commended for its responsiveness to the concerns raised in OMB's 8/20/96 terms of clearance for the ICR associated with the proposed rule. EPA is reminded that it should review the burden associated with this collection when it revises the information collection approved under OMB 2060-0349 (NESHAP for hazardous waste combustors) as part of the hazardous waste combustor MACT final rulemaking, and submit change worksheets as necessary to: 1) allocate burden appropriately between the two collections; 2) amend the BIF universe (i.e., the hazardous waste combustor universe for this collection) to reflect any changes associated with the comparable fuels exclusion; and 3) ensure that burden borne by respondents' contractors is included in the hour burden reported in block 13 of Form 83-I and not in the cost burden reported in block 14. For the record, it is noted that this ICR was originally submitted to OMB as a new collection. Pursuant to an EPA request dated 4/9/98, this ICR was reviewed and approved as a revision of the collection previously approved under OMB 2050-0073.

Generators and burners of comparable/syngas fuels will have to demonstrate compliance with the provisions of the exclusion from the definition of solid waste under 40 CFR Part 261, Under Part 63, Subpart EEE, public notification provisions require HWCs to submit materials outlining their plan to comply with forth coming NESHAP standards.
