This information collection request is not approved, pursuant to the provisions of 40 CFR part 1320. OMB is concerned that the proposed addition of latitude and longitude to the mandatory elements in the RMP registration may lack practical utility. Prior to submission to OMB of the ICR associated with the final rule, EPA should address the practical utility of these data elements. In addition, EPA should: -- provide an explicit description of the confidentiality provisions that will be used for confidential business information (CBI), to include a summary of the relevant provisions in 40 CFR part 2 subpart B, and circumstances under which CBI would be made available to parties outside the Agency as detailed in section 2.209 and elsewhere in the subpart. -- clarify the applicability of 40 CFR 2.301 to information obtained under this collection. -- clarify the total number of annual responses anticipated to this collection. -- address commenters' concerns that not allowing submission of written plans in hard copy as an alternative to electronic submission may be unduly burdensome. -- address commenters' concerns that requiring use of the NAICS rather than the SIC in the initial RMP submission may be burdensome to the regulated public. -- ensure that its ICR submission contains all forms applicable to the collection, or where electronic submission is anticipated, a detailed description of the data fields and format used for such submissions. EPA should respond to these comments and any comments from the public on this ICR in both the preamble of the notice of final rulemaking and the supporting statement of the ICR associated with the final rule.

This Information Collection Requirement (ICR) is amending the ICR submitted with the Final Risk Management Programs Rule ("RMP RULE on June 20, 1996, for registering sources documenting risk management programs, and submitting a risk management plan (RMP) under section 112(r)(7)(B) of the Clean Air Act, as amended. The amendments to the final RMP rule, proposes sources to submit a sanitized, unsanitized version of the RMP and an upfront substantiation for each Confidential Business Information claim that is submitted in the RMP. EPA estimates that the only sources that may be subject to this ICR is only about 4000 chemical etc.
