Terms of Clearance: OMB would like to review agency responses to public comment on the information collection requirements in this rule before taking final action. Currently, the burden estimates appear to represent an upper bound on the actual burden which will result from this rule. Prior to final action, it would be help to try to determine what burdens would be entailed in the "normal course of business" while better estimating the incremental burdens entailed by the rule. RSPA's current regulatory evaluation describes several reasons why the current estimates are likely to be overstated. It is also desirable for RSPA to make estimates that may be based upon, but independent of, cost estimates provided by the industry. Finally, the burden of some 2.2 million hours would represent a significant increase in overall Departmental burden. DOT and RPSPA/OPS should do everything possible to minimize the incremental burden of this program while responding to legitimate safety needs.
